Outgoing Virginia Governor Declares a State of Emergency, Incoming Governor Plans Legal Challenge to Vaccine Mandates

In response to a spike in hospitalizations, on Monday Governor Ralph Northam declared a 30-day state of emergency in the Commonwealth. Maryland and Delaware Governors took similar action recently.

northam youngkinGovernor-elect Glenn Youngkin's transition team has signaled that the order will remain in effect. Youngkin will take office later this week and has announced that he will move quickly to challenge federal vaccine rules that took effect Monday.

Glenn Yougkin and Attorney General-elect Jason Miyares released a joint statement late last week pledging to take action to halt the Biden Administration’s emergency temporary rules stating, “While we believe that the vaccine is a critical tool in the fight against COVID-19, we strongly believe that the Federal government cannot impose its will and restrict the freedoms of Americans."

The U.S. Supreme Court heard arguments on Friday and is weighing whether to halt the Biden administration's private employer COVID-19 vaccine-or-testing rule as well as mandates for health care workers at Medicare and Medicaid-covered facilities.
